TERMS OF BUSINESS
- Definitions
1.1 In these terms of business the following words will have the following meaning:
“Damages” losses, damages, costs, fines and expenses (whether direct, indirect or consequential).
“Group” a Reservation which is made by you for more than one person to visit the Location.
“House” the house being part of the Location.
“Location” the house and gardens (including car parks, tearooms and other amenities) at Cottesbrooke Hall & Gardens (or any part of them).
“Reservation” the reservation made by you to visit the Location as stated on the booking form.
“Visit Time” the date and time stated on the booking form for you or the Group to visit the Location.
“we/us” Alastair Macdonald-Buchanan (trading as Cottesbrooke Opening Partnership).
“you” the organiser of the Reservation as stated on the booking form.
- Contract
2.1 The contract for the Reservation is between you and us and comprises the booking form and these terms and conditions. This means that you will be liable for payment of the full price irrespective of whether the Reservation is just for you or for a Group. You are also responsible for all other obligations which apply to you under these terms of business.
2.2 All advertising and descriptions given by us or any third party relating to the Location on our or their websites or in any brochures or leaflets will not form part of the contract between you and us. Although we do our best to ensure that all of our advertising and descriptions are accurate we will not accept liability if there are any inaccuracies.
2.3 The Reservation will be for the Visit Time stated on the booking form. If you or your Group do not arrive within 30 minutes after the Visit Time then this will be treated as a cancellation by you and you and your Group will be refused admittance to the Location. Clause 4 will apply in these circumstances.
- Prices
3.1 The price of the Reservation is as stated on the booking form.
3.2 The full price is payable at the time of the booking.
- Cancellation by you
4.1 If the Reservation is cancelled by you for any reason after you have made the booking then the full price is still payable and no refund will be made.
- Cancellation by us
5.1 We reserve the right to cancel the Reservation for any reason. In these circumstances we will notify you of the cancellation as soon as possible.
5.2 If we cancel the Reservation then we will refund all monies which you have already paid but we will have no other liability to you for any Damages which you or any person in your Group have incurred as a result of the cancellation.
- Transfer of booking
6.1 You cannot transfer this Reservation to another person without our consent.
6.2 If you are making the Reservation for a Group then you cannot transfer the Reservation to another person without our consent. You may however (subject to clause 6.3) change the names of the other people in the Group.
6.3 If the number of people in the Group is reduced from the number on the booking form then no reduction will be made to the price and you will still be liable to pay the full price as stated at the time of booking. You cannot add additional people to the Group from the number on the booking form and if any additional people arrive at the Location they will not be admitted.
- Facilities
7.1 We reserve the right to close or alter any facilities and amenities at the Location if this is necessary for technical or operational reasons. We will not be required to give you advance notice of this. No refund of the price or any part of it will be made in these circumstances.
- Children
8.1 Children under the age of 14 must be accompanied by an adult at all times whilst at the Location. Adults who are accompanying such children will be responsible for supervising them.
- Security
9.1 We reserve the right to refuse to allow a person to enter the Location or to remove a person from the Location at our entire discretion. We will however explain to the person the reason for our decision.
9.2 No large bags, rucksacks, prams or pushchairs will be allowed in the House. We will however provide an area where these can be stored.
9.3 We reserve the right to search the bags of any person visiting the Location.
9.4 No photographs or videos may be taken or filmed in the House.
9.5 No valuables should be left on display in vehicles parked at the Location.
- Health & Safety
10.1 Entry to the House will only be allowed for visitors who are wearing flat shoes.
10.2 The paths throughout the Location may be slippery particularly in wet or frosty weather.
10.3 The water in the ponds throughout the Location is deep.
10.4 No dogs (except for assistance dogs) are permitted at the Location.
10.5 Access for disabled visitors to certain parts of the Location is restricted.
- Parking
11.1 Free car parking is available at the Location.
11.2 We do not accept any liability for any loss or damage to vehicles parked at the Location or their contents unless this has resulted directly from our negligence.
- Liability
12.1 We do not accept any liability for any Damages arising from personal injury suffered by you or any member of your Group whilst at the Location or arising from any loss or damage to your property or the property of any member of your Group whilst at the Location unless this has arisen directly as a result of our negligence.
